HINIHILING ni Vice President Sara Duterte sa Supreme Court (SC) na ibasura ang kasong may kaugnayan sa legalidad ng alokasyon sa P125 milyon ‘confidential fund’ sa Office of the Vice President (OVP) noong 2022.
Sa kanyang 16-pahina consolidated comment,iginiit ni Duterte sa pamamagitan ng kanyang abogado na si dating Solicitor Estelito Mendoza na maibasura ang tatlong petisyong inihain nina dating Commission on Elections chairperson Christian Monsod, Atty Howard Calleja at ACT Teachers Party-list.
“None of the petitions present an actual case or controversy, and none of the petitioners alleged a legal, demandable, and enforceable right which calls for the exercise of judicial power,” ayon sa komento ni Duterte.
Aniya,giniit pa ng kampo ni Duterte na hindi mandato ng SC na sagutin ang lahat ng kuwestiyonableng tanong dahil ang mga nabanggit na petisyon ay pawang spekulasyon lamang kaugnay sa contingent funds.
It iis not an unbridled authority to review just any claim of constitutional violation or grave abuse of discretion,”ayon pa sa komento ni Duterte.
Magugunitang sinabi ng mga petitioner na iligal ang paglilipat ng P125 milyon pondo sa OVP at dapat itong isailalim sa audit ng Commission on Audit (COA).
