Hindi magbibigay ng extension sa deadline ang Commission on Elections (Comelec) sa pagsusumite ng mga kandidato ng kanilang statements of contributions and expenditures (SOCEs).
Ayon sa 19-pahinang desisyon ng Supreme Court (SC) noong Oktubre 2021 na kamakailan lamang inilabas sa publiko, idineklarang void ng SC En Banc ang
Comelec Resolution No. 10147, na nage-extend sa pagsusumite ng SOCE noong 2016 na Isang kasuklam-suklam sa batas.
“Clearly, the Comelec committed grave abuse of discretion in issuing the assailed resolution,” ayon sa SC.
“The arbitrary extension of the deadline for the submission of the SOCEs effectively condoned the erring candidates and political parties from the administrative liabilities even if the law does not provide any exempting circumstance,” dagdag pa ng SC.
Gayunman, sinabi ng SC na ang mga SOCE na isinumite noong 2016 national and local elections ay naayon sa itinakdang deadline.
Ang desisyon ng SC en banc ay nagmula sa petition for certiorari na isinampa ng Partido Demokratiko Pilipino-Lakas ng Bayan noong Hulyo laban sa nabanggit na Comelec resolution.
Bukod pa dito, napag-alaman sa SC na ini-extend na ng Comelec ang deadline sa paghahain ng SOCE noong 2010 at 2013 pero hindi kinuwestiyon ang submission ng SOCE noong 2010 at 2013 hanggang sa paghahain ng petisyon noong 2016.
“The Congress fixed the period to file SOCEs ‘within 30 days after the day of the election.’ Hence, the Comelec cannot arbitrarily extend the deadline and substitute its own wisdom in defiance with the clear legislative intent,” dagdag pa ng SC.
