A three-page resolution was issued by the Senate Electoral Tribunal (SET) dismissing the quo warranto petition which questions the citizenship of Senator Erwin Tulfo and seeks his removal from office.
“Nagpapasalamat ako sa Diyos at na-dismiss na ang kasong ito na paulit-ulit na ipinupukol sa akin. Also, I would like to thank the members of the SET for carefully reviewing and finally dismissing this case based on the pieces of evidence my lawyer, Atty. Karen Jimeno, submitted,” Tulfo said.
The resolution said that the petition for quo warranto was dismissed “being insufficient in form,” pursuant to Rule 23(a) of the 2020 SET Rules which states that the tribunal may summarily dismiss a protest or petition if it is insufficient in form or substance.
A quo warranto petition must clearly lay out specific elements, including the office contested, the petitioner’s standing, the respondent’s qualifications and the particular grounds for disqualification, the resolution said, noting that the petitioner failed to comply with these standards.
“Accordingly, the petition for quo warranto is dismissed for being insufficient in form,” the resolution dated March 2, 2026, said.
TIt was signed by Supreme Court Senior Associate Justice Marvic Victor Leonen as chair, and Associate Justices Ramon Paul Hernando and Henri Jean Paul Inting as members while the Senator-members who concurred were Pia Cayetano, Robinhood Padilla, Francis Pangilinan, Bam Aquino and Camille Villar.
