Isinampa ng Bureau of Corrections (BuCor) sa Department of Justice (DOJ) ang kasong plunder at iba pang kaso laban sa suspendidong BuCor chief Gerald Bantag at anim na iba pa, kaugnay sa hindi natapos na konstruksiyon ng tatlong prison facilities na nagkakahalaga ng P300 milyon.
Kasamang kinasuhan ni Bantag sa DOJ sina CTSSUPT Arnold Jacinto Guzman, CTINSP Ric Rocacurba, CO1 Solomon Areniego, CTO1 Jor-el de Jesus, CTO2 Angelo Castillo, at CTO 2 Alexis Catindig.
Bukod sa kasong plunder na isang non-bailable offense, nahaharap rin sila Bantag sa kasong malversation of public funds thru falsification of official documents, graft and corruption, violation of the Code of Conduct and Ethical Standards for Public Officials and Employees.
“Bantag, in conspiracy with, and with indispensable complicity of, the other herein respondents, has purposely and systematically orchestrated the diversion/misappropriation and/or consenting or permitting other persons to take public funds, of the Bureau of Corrections, ” ayon sa 9 na pahinang complaint-affidavit na isinampa sa pangunguna ni BuCor OIC Gregorio Catapang.
Ayon sa reklamo,habang si Bantag ay BuCor director, isinagawa ang P1 bilyon project para sa konstruksiyon ng tatlong prison facilities sa Davao Prison and Penal Farm (Lot 1), Iwahig Prison and Penal Farm (Lot 2) sa Puerto Princesa, Palawan, at Leyte Regional Prison (Lot 3) noong Setyemnre 17,2020.
Napag-alaman na lumikha si Bantag ng hiwalay na BuCor’s Bidding and Award Committee (BAC) at itinalaga ang non-permanent officials ng BuCor, na sina CT SUPT John Paul Santos at CSUPT Virginia Mangawit, na pawang personnel ng Bureau of Jail Management and Penology (BJMP), bilang Chairperson at miyembro ng BAC.
Ang ginawa ni Bantag ay malinaw umanong paglabag sa Section 65 of RA 9184 o ang Government Procurement Reform Act and Section 11.2. 2 of the 2016 Revised Implementing Rules and Regulations of RA 9184.”
Sa naganap na bidding ng tatlong prison project, ang BAC, kasama na ang respondent na si Rocacurba, ay inayos ang public bidding at idineklara na ang Joint Venture of CB Garay Philwide Builders at Rakki Corporation ang nanalong bidders para sa konstruksiyon ng Lot 1 at Lot 2, at anh Joint Venture ng CB Garay Philwide Builders at Evans Sesbreño ang para sa lonstruksiyon ng Lot 3.
Sa isinagawang imbestigasyon,nalaman na ang mga naturang pribadong kumpanya ay hindi kuwalipikado dahil sa kawalan ng mandatory mandatory requirement ng Statement of Single Largest Completed Contract (SLCC).
Si Bantag at ilang opisyal pa ng BuCor ang sinampahan ng kasong two counts of murder kaugnay sa pagpatay sa broadcaster na si Percy Lapid at midddleman na si Jun Villamor.
