Kasong rape at acts of lasciviousness ng Department of Justice (DOJ) ang isinampa laban sa dalawang independent television network contractors sa Pasay City regional trial court (RTC), dahil sa pangmo-molestiya umano sa aktor na si Alessandro “Sandro” Muhlach.
Kinumpirma ni Officer-In-Charge Prosecutor General Richard Anthony Fadullon ang pagsampa ng kasolaban kina Richard D. Cruz at Jojo T. Nones.
Ang kaso laban kina Nines at Cruz ay isinampa ng DOJ matapos makitaan ng probable cause sa isinagawang preliminary investigation para makasuhan sina Cruz at Nones.
“Yung rape dito would have no bail recommended recommended,”ani Fadullon.
Matatandaang sinabi ni Sandro na ang insidente ay naganap noong Hulyo 20,2024 sa loob ng kuwarto sa isang hotel sa GMA Gala.
“After due to deliberation and examination of the pieces of evidence submitted by Sandro, the undersigned panel of prosecutors found prima facie evidence with reasonable certainty of conviction to charge respondents RIchard and Jojo for sexual assault under Art. 266-A, par.2, of Republic Act No. 8353 (the Anti-Rape Law of 1997), as amended, and Acts of Laciviousness under Article 336 of the Revised Penal Code as amended,” ayon sa resolusyon ng DOJ panel of prosecutors.
Ayon sa prosecutors, na-establisa umano na nagkaroon ng puwersa at pananakot kung saan nang oras na iyo, si Sandro ay mahina dahil sa epekto ng drugs at alcohol.
Sa kanyang affidavit, sinabi ni Sandro na paulit- ulit siyang nakiusap sa mga respondent na itigil ang ginagawa nilang pangmo-molestiya.
Ayon kay Fadullon, sa kabila nang parang normal na lumabas si Sandro sa hotel room ay hindi nangangahulugan na hindi ito naabuso.
